Service Agreement
The customer requesting BertoLegal Services to pick up and/or deliver any package or item, to process any court filing, or to render any services pursuant to this Order Form, agrees to all the terms and conditions set forth herein. For purposes hereof, the term “customer” is the person and/or account to which the subject charges are billed, or charged to.
Customer shall be responsible for payment of any and all charges for services by BertoLegal, including the advancement of any fees on behalf of customer, even if special arrangements are made for a third party to make any such payments.
Customer agrees that in the event of any loss or damage to any package or item, the liability of BertoLegal will be limited to the lesser of the actual damages or $100.00. In the event any court or other filing is determined improper as a result of any error or omission by BertoLegal, customer is entitled to a refund of BertoLegal service charges. Customer agrees that BertoLegal shall not be liable for any loss, damage or delay for services rendered by Bertolegal, or its agents, resulting from factors which BertoLegal could not foresee or control, including but not limited to “Acts Of God”, weather conditions, mechanical delays or computer malfunctions. Customer agrees that BertoLegal shall not be liable under any circumstances for any incidental, consequential or special damages, even if BertoLegal was made aware that such damages might be incurred.
Customer agrees to indemnify and hold BertoLegal harmless of and from any and all claims which may be asserted by any third party recipient, sender, or beneficiary.
Customer agrees to pay for the charges incurred for the services rendered by BertoLegal, net 30 days, upon receipt of the invoice for such services. Charges not paid within thirty (30) days shall carry interest at the rate of ten percent (10%) per annum and will be charged to the Customer’s credit card that is required to guarantee payment when opening the account.
This constitutes the entire contract between the parties, and no agent or representative of BertoLegal has authority to alter, modify, or waive any these terms or conditions. BertoLegal makes no warranties, express or implied, which in any way concern the transaction.
